    In House Complaints Procedure

    We are committed to providing a professional service to all our clients and customers. When something goes wrong, we need you to tell us about it. This will help us to improve our standards.

    If you have a complaint, please put it in writing, including as much detail as possible. We will then respond in line with the timeframes set out below (if you feel we have not sought to address your complaints within eight weeks, you may be able to refer your complaint to the Property Ombudsman to consider without our final viewpoint on the matter).

    What will happen next?

    · We will send you a letter acknowledging receipt of you complaint within three working days of receiving it, enclosing a copy of this procedure.

    · We will then investigate your complaint. This will normally be dealt with by the office manager who will review your file and speak to the member of staff who dealt with you. A formal written outcome of our investigation will be sent to you within 15 working days of sending the acknowledgement letter.

    · If, at this stage, you are still not satisfied, you should contact us again and we will arrange for a separate review to take place by a senior member of staff.

    · We will write to you within 15 working days of receiving your request for a review, confirming our final viewpoint on the matter.

Information For Tenants

    At A Wilson Estates, we understand how stressful moving house can be, and so we have put together this guide to try and help the process go as smoothly as possible.

    Once you have found a suitable property, please contact our friendly lettings team, who will, subject to availability, book you an appointment to conduct an internal viewing of the accommodation and will answer any queries that you may have. As part of this process, we will need to qualify that you meet the criteria required for the property.

    As there is likely to be a very high level of interest in each property that is marketed to let, we cannot guarantee that a viewing can be booked for you, and we would encourage you to make contact with us as soon as possible should you find a suitable property.

    Once you have viewed a property, please contact our offices to confirm your interest in undertaking a tenancy. Again, as we expect high levels of interest on each property that is marketed, it is important that you register your interest as soon as possible. In the event that multiple parties register an interest in a property, then the landlord shall have the final decision on which parties are invited to submit an application for the property.

    If you are invited to make an application for the property, we will contact you to advise. In order to secure the property whilst the relevant credit references are obtained, you will be required to pay a holding deposit, equivalent to 1 weeks rent, the amount of which will be confirmed to you in writing.

    Upon receipt of the holding deposit, we will register your details with our referencing partners, who will be in contact via email, with further instructions on how to complete your online application form. Please ensure that you complete the form(s) as fully and as accurately as possible. Your application may be rejected and your holding fee retained, if you provide false or inaccurate information, or you fail a right to rent check.

    In line with new government legislation, we will be required to carry out a 'Right to Rent' check, to make sure that all tenants have the required permissions to rent a property in the U.K. You will be given details of the types of check that may be required upon application.

    To view the legislation, and to assess which type of documentation you may be required to provide, please visit www.gov.uk and search for right to rent.

    In certain circumstances, a tenant guarantor may be required. If this is the case, we will advise you of the criteria required.

    By paying a holding fee, and/or submitting your application does not constitute an offer of a tenancy, nor does it infer at this stage that a tenancy will be granted.

    Subject to the successful completion of your references, we will be in touch with you to advise, and to discuss booking in a move in date for you. Once we have confirmed this with you, we will advise on the remaining balance of rent and deposit to be paid prior to your check in. These funds must be received at least 24 hours in advance of your move in taking place.

    Once the move in date has been agreed, we will visit the property beforehand to undertake an inventory and condition report, which will be sent to you via email, along with copies of the proposed tenancy agreement, deposit prescribed information, and all of the required certification and documentation as required by the Deregulation Act 2015. Most of the documents can be signed electronically, so you should only be required to call at the office on your move in day to collect your keys. If this is any different, then we will advise you beforehand.

    Once you have completed your check in, you will need to review your inventory & condition report, and advise us of any discrepancies as soon as possible.

    When we have finalised your move in, we will inform the local authority, who will register you as being the person(s) responsible for the council tax at the property. It will be your responsibility to set up the energy accounts for gas, electric and water, using the meter readings (if applicable) that are contained within your check-in inventory.

    After your move in, we will send you a link via email, where you can register for your PropertyFile account. This will allow you to view all of your tenancy and property information, and will also enable you to report any repairs or maintenance requests via your dedicated portal 24 hours a day.

    Tenant Fees Act 2019

    In line with the tenant fee act of 2019, there may be occasions where certain 'permitted payments' may be requested by the tenants, and a list of these are below for information. If you have any queries regarding any of these permitted payments, please do not hesitate to get in contact with us.

    Default Fees and Damages Payments

    1. Late Rental Payments.

    A default fee may be payable if the rent is at least 14 days late from the rent payable date as set out in the tenancy agreement. The default fee shall be no more than 3% above the Bank of England's base rate for each day that a payment has been outstanding.

    2. Lost keys or security devices

    A default fee may be charged in the event that the tenant loses keys or other security devices for the property they tenant. The default fee shall be payable to the landlord or their agent upon receipt of written evidence, usually in the form of an invoice from the contractor providing the replacement(s). Such fees shall be reasonable, and details will be provided within the tenancy agreement of such a default.

    Other permitted charges.

    1. Changes to a tenancy.

    Should the tenant wish to make a change to the existing tenancy agreement, then a permitted charge of no more than £50 will be payable by the tenant in advance of such change. This change could be for example, being allowed to keep a pet, a change in sharer of a joint tenancy, permission to sublet, although this list is not exhaustive. If you are unsure whether a fee may be payable to make a change, please ensure that you contact the agent. Should the cost be expected

    2. Early Termination of a fixed term agreement.

    Should the tenant request to terminate a fixed term tenancy agreement earlier than the scheduled termination, then the landlord or their agent may request a permitted charge, in order to remedy any loss incurred by either party. This would usually be the landlords or agents costs involved in advertising, referencing, or loss of rent resulting from an early termination. Should a request for early termination be made by the tenant, then such fees will be confirmed in writing, and will be no more than any loss incurred by either the landlord or their agent.

    Other General payments in connection with your tenancy.

    1. The rent.

    2. A refundable tenancy deposit which will be capped at no more than five weeks rent for annual rents under £50,000 or six weeks rent where the rent is over £50,000 annually.

    3. A refundable holding deposit capped at no more than one weeks rent in order to reserve your chosen property.

    4. Payments in respect of utilities, communication services, TV licence and Council Tax. Unless these are included with your rent, you will be required to make these permitted payments. If these payments are included with your rent, or are charged separately by your landlord, then they will be governed by the Maximum Resale Price provisions set by OFGEM.

        S Lopez- I began purchasing a house through A Wilson last year. There have been a number of hurdles due to the current climate, namely searches taking so long. Everyone whom I have spoken to at A Wilson have been friendly, helpful and polite whilst remaining a level of professionalism that puts them ahead of their competitors, whom I am selling my property through. Lucy in particular is efficient, chatty and keeps in regular contact. She doesn't put me under pressure when she calls for an update and she has always helped me with enquires or routes to take, even with the sale of my property. Purchasing a property through A Wilson has shown me that it's better to go through an independent estate agent, where the staff seem to be invested in helping all parties and keeping people happy.
