(a) the right to lay down and use for the passage of water and soil any sewers or drains passing through or under the property conveyed or any part thereof TOGETHER WITH full right and liberty to enter upon the property hereby conveyed for the purpose of constructing laying down maintaining inspecting repairing cleansing or making connections with such sewers or drains the Vendors or other the person or persons exercising such rights and liberties making good as far as possible all damage thereby caused. The Purchaser in common with all other persons entitled to use the same paying a proportionate part of the expense of keeping any drain from the property hereby conveyed into the main sewer in good repair and condition"
3 The Conveyance dated 1 February 1963 referred to above contains the following provision:- "IT IS HEREBY AGREED AND DECLARED as follows:- (a) The Purchaser and his successors in title shall not by reason of anything herein contained acquire or claim any right of access to or for light or air which would or might interfere with the use of any adjoining or neighbouring property belonging to the Vendors and forming part of their Dallington Estate for building or other purposes. (b) The property hereby conveyed forms part of a building estate belonging to the Vendors and they the Vendors expressly reserve the right of making from time to time any alteration in the mode of laying out the said estate and in the number and area of the plots thereon the class of building and the minimum cost thereof and in the special and general conditions of sale to waive vary release or abandon any of the special conditions or any covenants entered into or to be entered into for carrying out the same in any manner the Vendors may think desirable. (c) The walls and fences forming the North West South West and South East boundaries of the said property shall be party walls and fences and the respective owners shall contribute accordingly to the cost of repairs thereto"
4 The Conveyance dated 12 July 1962 referred to in the Charges Register contains the following exceptions and reservations and this registration takes effect subject thereto:- EXCEPT AND RESERVED unto the Incumbent and his successors (i) all minerals in and under the property thereby conveyed together with full power and authority to work and get the same by underground workings only and making to the Purchasers and their successors in title reasonable compensation for all damage done or caused to the said property or any buildings thereon the amount in case of difference to be ascertained by a single Arbitrator in accordance with the provisions of the Arbitration Act. (ii) full and free right and liberty without obtaining the consent of or making any compensation to the Purchasers or other the owner or owners occupier or occupiers for the time being of the said property thereby conveyed to deal in any manner whatsoever with any of the land belonging to the Incumbent adjoining or near to the said property thereby conveyed (including the Church and Churchyard) and to erect and maintain or suffer to be erected or maintained on such adjoining opposite or neighbouring lands any buildings whatsoever whether such buildings should or should not affect or diminish the light or air which would then or at any time or times thereafter be enjoyed for or in respect of the property thereby conveyed or any building for the time being thereon and (iii) the free flow of water and soil and the passage of water gas and electricity and or public or private services from any adjoining land belonging to the Incumbent (including the Church and Churchyard) through any drains and watercourses pipes conduits and cables then existing in the said property thereby conveyed or substituted therefor by the Purchasers.
