INTRODUCTION

The land coloured purple, red, blue and yellow on the attached plans is being offered to let by way of a six-year Farm Business Tenancy. Available as a whole or in up to four Lots.

TENANCY AGREEMENT
The land is to be let under a six-year Farm Business Tenancy and the requisite Notices will need to be exchanged prior to the letting. The Tenancy will make provision for the following matters amongst others: -

a) The tenancy will be granted to an individual who will be personally responsible for farming the land (either on his/her own account or as a Partner or Director of a farming business)

b) The Tenancies whether the land is let as a whole or in Lots will commence on 11th October 2024 and expire 10th October 2030

c) Rent will be payable half yearly in advance on 11th October and 6th April in each year, the first payment being due on 11th October 2024

d) The rent will be capable of review in accordance with the Agricultural Tenancies Act 1995

e) No Genetically Modified or Maize crops are to be grown on the holding

f) The incoming Tenant is to hold suitable public liability insurance (minimum £10,000,000)

g) The Land is let on a full repairing basis. The Tenant will be required to put and keep the land in good tenantable condition

h) The Tenant shall not be able to assign or under-let or share possession of the land or enter into any cropping licences with third parties

i) The Tenant will be required to use the land solely for agricultural purposes; specifically the growing of crops.

VAT
The Landlord reserves the right to charge VAT on the rent. The land is not currently opted for VAT.

CONDITIONS OF TENDER
1. Tenders are to be submitted in writing on the attached form not later than 12 noon on Friday 16th August 2024 marked "Arable Land at Hale Fen, Dairy Drove, Coles Pieces and North Fen, Black Bank Road, Littleport' Tenders by email or post are acceptable.

2. Tenders to be for a fixed sum of money and not a sum of money calculable by reference to any other tender.

3. The Landlord reserves the right not to accept the highest or any other tender.
4. Potential Tenants will be advised of their success or otherwise of their tender within ten working days, subject to satisfactory references being obtained if necessary.
5. Potential Tenant(s) will be bound by their tender as soon as their tender has been accepted and they are notified of their success.
6. The successful Tenant(s) will be required to sign a Farm Business Tenancy Agreement to be prepared by Brown & Co. acting for the Landlord.
7. References may be required.
